We create sensory products, original artwork, and augmented-reality experiences designed to inspire presence, imagination, and deeper connection. These Terms of Use explain the expectations that help us protect our customers, our artists, and the creative work we bring into the world.

By using this website, placing an order, registering artwork, or accessing an Elevated Culture® augmented-reality experience, you agree to these terms.

PRODUCTS AND CREATIVE EXPERIENCES

Elevated Culture® may offer original artwork, limited-edition prints, augmented-reality experiences, candles, room and linen sprays, merchandise, and other creative or sensory products.

We make every reasonable effort to present our products accurately. Because some products are handcrafted or produced in small batches, slight variations in color, texture, fragrance, finish, packaging, or appearance may occur. Screen settings may also affect how colors appear online.

ORDERS, PRICING, AND PAYMENT

All prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and other costs will be displayed during checkout.

Submitting an order does not guarantee acceptance. Elevated Culture® may cancel or limit an order because of inventory availability, pricing errors, suspected fraud, or other reasonable circumstances. If we cancel an order after payment has been processed, the appropriate amount will be refunded.

AUGMENTED-REALITY ARTWORK

Some Elevated Culture® artwork includes a digital augmented-reality layer that can be experienced through a compatible phone, tablet, application, or online platform.

The length of the initial AR-access period will be identified with the artwork, product description, registration information, or Certificate of Authenticity.

After the included access period ends, continued access to the AR experience is available for an annual service fee of $50. This fee supports digital hosting, platform maintenance, compatibility updates, and future experience enhancements.

The annual fee may increase modestly over time as technology and operating costs change. Elevated Culture® will communicate any price adjustment before renewal is required.

If the collector chooses not to renew, access to the AR experience will end. The collector will continue to own the physical artwork and its Certificate of Authenticity.

Because AR technology depends partly on third-party devices, applications, and platforms, Elevated Culture® cannot guarantee permanent compatibility with every device or operating system. We will make reasonable efforts to maintain and support the intended experience.

ARTWORK OWNERSHIP AND COPYRIGHT

Purchasing an original artwork or print gives the collector ownership of that physical item. It does not transfer the artist’s copyright, reproduction rights, commercial-use rights, or ownership of the related AR content unless a separate written agreement says otherwise.

Elevated Culture®, its artists, and its licensors retain all applicable rights to the artwork, animations, audio, videos, designs, photographs, written content, product names, logos, and digital experiences.

Collectors may photograph and share their purchased artwork or AR experience for personal, noncommercial purposes. The artwork may not be reproduced, altered, sold as another product, licensed, or used commercially without written permission.

SENSORY AND WELLNESS PRODUCTS

Elevated Culture® sensory products are created to support atmosphere, reflection, creativity, and personal ritual. Individual experiences and fragrance preferences will vary.

Our products are not intended to diagnose, treat, cure, or prevent any medical or mental-health condition. Information provided on this website is for general educational and lifestyle purposes and should not replace professional medical advice.

Always follow the directions and safety information included with each product. Candles should never be left burning unattended and should be kept away from children, pets, drafts, and flammable materials. Room and linen sprays should not be swallowed or applied directly to the body unless the product is specifically labeled for that purpose. Test sprays on a small, hidden area of fabric before wider use.

SHIPPING, RETURNS, AND EXCHANGES

Shipping estimates are provided in good faith but are not guaranteed delivery dates. If an order is significantly delayed, we will communicate available options.

Returns, exchanges, damaged-item claims, and eligible refunds are handled according to the Shipping & Returns Policy displayed on this website and in effect at the time of purchase. Please review that policy before completing an order.

WEBSITE AND ACCOUNT USE

You agree to use this website only for lawful purposes. You may not attempt to disrupt the website, gain unauthorized access to customer or business information, copy protected content, introduce harmful code, or use the website in a way that interferes with another person’s experience.

If you create an account, you are responsible for keeping your login information secure and for activity conducted through your account.

THIRD-PARTY SERVICES

Some website features, payments, AR experiences, shipping services, or links may be provided by third parties. Their services may be governed by separate terms and privacy policies. Elevated Culture® is not responsible for interruptions or changes made by independent third-party providers.

PRIVACY

Information collected through this website, artwork registration, or AR activation will be handled according to our Privacy Policy. Registration information may be used to provide access, customer support, renewal notices, and experience-related updates.

LIMITATION OF LIABILITY

To the fullest extent allowed by law, Elevated Culture® will not be responsible for indirect, incidental, or consequential losses resulting from misuse of a product, failure to follow provided instructions, incompatible technology, third-party service interruptions, or unauthorized use of website content.

Nothing in these terms removes any consumer rights or protections that cannot legally be limited.

CHANGES TO THESE TERMS

As our products, technology, and creative experiences evolve, these terms may also be updated. Any revisions will be posted on this page with a new “Last updated” date. Continued use of the website after an update means you accept the revised terms.

GOVERNING LAW

These terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
